Why does capitalism reign so supreme, beyond the reach of any effective challenge to its rule over American life? One important reason, obscured by the excessive veneration of legal doctrines like the clear and present danger test and unwarranted esteem for liberal jurists like Holmes and Brandeis, is that for a crucial period extending through most of the Twentieth Century it was a crime merely to be an economic radical. Under the unchecked authority of a host of state and federal statutes that purported to criminalize “syndicalism,” “sedition,” and “anarchy,” thousands of leftists and industrial unionists were imprisoned; their lives were shattered and their organizations left battered, even though most all of them were peaceful people whose real crime was to organize industrial unions that challenged the interests of powerful business-people. Lost to legal scholars, historians, and journalists alike, this story of how “every red became a criminal” brings to light unpleasant truths about the nature of law and the state in capitalist society.

This event is free for all Colorado Law students, faculty, and staff, recent graduates (2012-2017), and Law Alumni Ambassadors, $10 for all other alumni, and $20 for other guests. CLE credit is requested, and a reception will follow the talk.
