Discussion on Recent Medical Marijuana Case

October 30, 2005

The Federalist Society hosted a discussion of the recently decided Raiche case (Medical Marijuana) by U.S. Attorney William J. Leone.

In Gonzales v. Raich case, the Supreme Court, Justice Stevens, held that application of CSA provisions criminalizing manufacture, distribution, or possession of marijuana to intrastate growers and users of marijuana for medical purposes did not violate Commerce Clause.

Following his presentation, the current Colorado Solicitor General and CU Law Professor, Allison Eid made comments on the case and the possible implications for Colorado residents.
