How District & Appellate Employment Caselaw are Evolving After Supreme Court Decisions. Reviews of new Supreme Court decisions are like profiles of new bands: they offer more detail than you need, with breathless hype about their potential to change everything; but a year or three later, the bias toward writing about new things leaves you wondering what became of them. Like the semi-popular VH-1 television series Where Are They Now?, which reported what became of some band, person, or cultural event that drew great attention years ago before fading from memory, this talk and paper analyze what district and appellate decisions arose from the following five important Supreme Court employment law decisions from 2013 to 2015, focusing on practical lessons attorneys can draw on how to litigate such claims and how to strategize employment disputes before litigation ever arises. (1) EEOC v. Abercrombie & Fitch Stores, Inc., 135 S. Ct. 2028 (2015) (on employers’ religious accommodation duties and knowledge of protected classifications); (2) Young v. United Parcel Service, 135 S. Ct. 1338 (2015) (on employers’ duties to accommodate pregnancy-related needs); (3) Integrity Staffing Solutions, Inc. v. Busk, 135 S. Ct. 513 (2014) (on what required off-the-clock tasks must be compensated for hourly-paid employees); (4) Vance v. Ball State University, 133 S. Ct. 2434 (2013) (on what mid-level managers qualify as “supervisors” triggering employer vicarious liability for harassment); and (5) University of Texas Southwestern Medical Center v. Nassar, 133 S. Ct. 2517 (2013) (on the “but-for” causation standard applicable to retaliation and certain other employment claims).
